Sarasota and Bradenton Rear-End Accident Attorneys

rear-end-accident.jpgRear-end collisions happen quite frequently in Florida. Many people assume that they can recover damages after being rear-ended in a motor vehicle accident. Often it is assumed that the rear driver was the sole cause of the accident. If the rear driver can produce evidence that shows that they are not solely responsible for the accident, the rear-end driver can rebut the presumption of fault for the accident. For instance, if the rear driver may is able to prove that the driver in front stopped suddenly or unexpectedly or had a mechanical failure, a jury can determine the degree of the rear-ending driver's negligence. 

Nissan Introduces "Driver Attention Alert"

attention-assist.jpgThere have been many reports of the dangers of drowsy driving and now Nissan has introduced its new "Driver Attention Alert" system available on the 2015 Nissan Murano crossover and the 2016 Nissan maxima. The system is able to adapt to each individual driver and using steering angle sensors it can monitor steering patterns. If the system detects a drowsy driver, it will display an amber coffee cup symbol on the dashboard and will also emit an audible sound, like a chime. The Driver Attention Alert (DAA) is a warning to make the driver aware of drowsiness or lack of attention. It cannot detect every potentially dangerous situation. 

More Airbag Recalls

airbags.jpgThe National Highway Traffic and Safety Administration (NHTSA) has launched an investigation into Nissan after the organization received over 120 complaints regarding Nissan airbag recalls. Even though a recall was announced in April, 2014, people are still complaining of problems with the airbags. The main issue with the airbags involves software that will read that the front passenger seat is empty when in fact an occupant is sitting in the seat. If the software indicates that the front passenger seat is empty, the airbag may fail to deploy during an accident leaving passenger vulnerable to severe injuries. 

15 Passenger Vans Have Significant Risks for Rollover Accidents

15-passenger-van.jpgJust recently in Florida, a horrific van accident claimed the lives of eight people. The van was carrying a group of people from a church revival in Fort Myers to their home in Fort Pierce. Along the way, the driver of the van missed a stop sign and plunged into a shallow ditch. Eight people were killed and two others were left in critical condition. The van was equipped to hold fifteen people and was carrying eighteen people instead. The National Highway Traffic and Safety Administration (NHTSA) has issued many warnings that 15 passenger vans are at high risk of rollovers especially if they are over-loaded. Newer 15 passenger vans now come equipped with electronic stability control systems. The older models don't contain these features and drivers are more likely to lose control. The NHTSA's research shows that a 15 passenger van carrying 10 or more occupants has a 3 times higher rollover rate than one carrying 5 passengers or less.
